End user license agreement for the computer game “IBA boxing game”

This License Agreement (hereinafter referred to as the "Agreement") is a legally binding agreement between you (an individual or a legal entity) (hereinafter referred to as the "Licensee") and the IBA (International Boxing Association) (hereinafter referred to as the "Licensor") regarding the computer game "IBA Boxing Game" (hereinafter referred to as the "Game"). By installing, copying or otherwise using the Game, the Licensee agrees to be bound by the terms of this Agreement.

1. Grant of License.

The Licensor grants the Licensee a non-exclusive, limited, revocable license to use the Game solely for personal, non-commercial purposes in accordance with the terms of this Agreement.

2. Restrictions.

The Licensee has no right to:

  • Distribute, transfer, rent or sublicense the Game.
  • Modify, decompile, disassemble the Game.
  • Use the Game for commercial purposes without the prior written consent of the Licensor.
  • Violate the copyright and other intellectual property rights of the Licensor.

3. Intellectual Property.

All rights to the Game, including but not limited to copyrights, trademarks, patents and trade secrets, belong to the Licensor.

4. Disclaimer.

The Game is provided "as is". The Licensor is not liable for any damages arising from the use of the Game.

5. Termination.

The Licensor has the right to terminate this Agreement if the Licensee violates any of its terms.

6. Applicable Law.

This Agreement is governed by the laws of the country in which this game is distributed.

7. In-game purchases:

By starting to use the game application, the User understands and unconditionally agrees that the game provides the ability to make in-game purchases. These purchases may include, but are not limited to: virtual currency, items, upgrades, content, as well as other digital assets intended for use exclusively within the gameplay.

The User acknowledges that in-game purchases are voluntary and are made at their own discretion. The User understands that purchased in-game items and assets are not subject to return or exchange for cash, except in cases expressly provided for by applicable law or the publisher's return policy.

8. The Publisher's Right to Change the Agreement:

The Publisher reserves the right to make changes, additions or exceptions to this agreement at any time and without prior notice to the User. Changes come into force from the moment they are published in the game application or on the publisher's official website.

The User undertakes to regularly check the agreement for changes. Continued use of the game application after changes to the agreement are made is considered the user's unconditional consent to the changes made. If the user does not agree with the changes made, he/she is obliged to stop using the game application.
The Publisher is not liable for any losses incurred by the user as a result of changes to the agreement.

9. User-Generated Content (UGC) and Code of Conduct

9.1. Content Responsibility: The Licensee (User) is fully responsible for any content they create, upload, post, or transmit through the Game (e.g., nicknames, team names, chat messages, etc.) (UGC).

9.2. Zero Tolerance for Objectionable Content: The Licensor enforces a policy of zero tolerance for objectionable or abusive UGC. By accepting this Agreement, the Licensee agrees not to create or disseminate:

Hate speech, discrimination, racism, sexism, or homophobia.

Pornographic or sexually explicit material.

Threats of violence, harassment, bullying, or personal attacks.

Collection or dissemination of other users' personal information without their consent.

Content that infringes upon the copyrights or intellectual property rights of third parties.

9.3. Moderation and Termination: Violation of these rules constitutes a basis for immediate termination of this Agreement and blocking of access to the Game.

10. Safety Mechanisms and Reporting

10.1. Content Filtering: The Licensor utilizes automated and/or manual methods to filter and detect objectionable UGC.

10.2. Flagging Mechanism: The Licensor provides users with a mechanism to report (flag) any UGC they believe violates these Rules.

10.3. User Blocking: The Licensor provides users with a mechanism to block other abusive or unwanted users to prevent further interaction.

10.4. Licensor's 24-Hour Obligation: The Licensor commits to acting upon all justified reports of objectionable UGC within 24 hours of receiving the report, which includes:

Removing the objectionable content.

Temporarily or permanently ejecting (banning) the user who provided the offending content from the Game.
This Agreement constitutes the entire agreement between the parties regarding the Game and supersedes all previous agreements and understandings.

11. Other Terms.

By agreeing to the terms of this Agreement, the Licensee confirms that he/she has read its terms and agrees to comply with them.
